Doddy v. Oxy USA, Inc., 101 F.3d 448 (5th Cir. 1996) — Lead trial and appellate counsel for Western Company of North America and presented argument adopted by the U.S. Court of Appeals for the Fifth Circuit in rejecting a claim for common law strict liability in an environmental and toxic tort case based upon ultrahazardous activity and, instead, requiring that claims for environmental damages in Texas must rest upon proof of negligence and not strict liability.
